Every year, millions of Americans suffer serious, sometimes fatal, personal injury in car accidents, slip and falls, trucking accidents, and more. In many cases, that injury is the direct result of the wrongdoing, negligence, or inaction of another party—whether an individual, corporation, or government entity. Fortunately, victims of personal injury have certain legal rights that are protected by law.

There are many areas in which persons may be injured due to the negligence of others.  These include automobile collisions, slip and fall, negligent security, maintaining defective premises, falling merchandise in a store, defective products, trucking accidents, medical malpractice and nursing home neglect.  Mr. McElroy has had experience in handling a wide variety of defense and plaintiff’s cases involving these forms of personal injury.

Personal Injury Claims

The area of law governing personal injury claims is known as tort law. Under tort law, an individual may file a claim for injuries sustained as a result of:

Auto/motorcycle/trucking accidents
Slip and fall accidents
Defective products
Medical malpractice
Nursing home abuse and/or negligence
Wrongful death
More

It is important for injured persons or their families to be aware of the relevant statute of limitations.  The statute of limitations is the time within a legal action must be filed.  If it is not filed within the appropriate timeframe, any future claim is barred.  In Georgia, the statute of limitations on personal injury is generally two years.  However, there are circumstances in which the effective time for filing a claim may be different.  For instance, with certain governmental entities an ante-litem or presuit notice is required within a timeframe such as six months in some circumstances and one year in others.  There are also circumstances which may extend the statute of limitations.  Thus, it is important for you to obtain legal representation as soon as practical after your injury so these factors, among others, can be assessed in a timely fashion.
